Terms of service

These terms govern your use of Vitrina Engine, a monitoring service operated by Infinity Curve LLC (“we”, “us”). By creating an account you agree to them. If you are agreeing on behalf of a company, you confirm you are authorised to bind it.

1. What the service is

Vitrina Engine checks whether systems you nominate are reachable and behaving as you have configured, records the results, opens incidents when checks fail, notifies the destinations you configure, and publishes status pages you create. It includes uptime, SSL certificate, DNS, TCP and DNS blacklist monitoring, and per-client workspaces. Features not listed on the pricing page are not part of what you are buying, whatever the interface may hint at.

It is a monitoring tool. It does not prevent outages, and it is not a substitute for your own redundancy, backups or incident process.

2. Your account

You are responsible for what happens under your account, including everything done by people you invite and by API keys you create. Keep your credentials secure and revoke access when somebody leaves — removing a member from your organisation also revokes the API keys they created.

You must be at least 18, and you must not create an account using someone else’s identity.

3. What you may monitor

You may only configure checks against systems you own or are authorised to test. Checks are HTTP requests, TCP connections and DNS queries made repeatedly from our infrastructure, and against a system you do not control that is indistinguishable from unsolicited traffic.

Our acceptable use policy forms part of these terms and sets out what we will suspend an account for.

4. Plans, limits and payment

Plans and their limits are published on our pricing page and are enforced as stated there. Prices are listed in US dollars, excluding tax. Paddle.com Market Ltd converts to your local currency and adds VAT, GST or sales tax where it applies; the exact amount in your own currency is shown before you pay, and it is that amount you are agreeing to.

Your order is fulfilled by Paddle.com Market Ltd, who act as our reseller and the merchant of record. They take the payment, issue the invoice, and are the party named on your statement. Their terms apply to the payment transaction itself.

Paid plans renew automatically at the end of each period until cancelled. There is no metered or overage billing on any plan: if you reach a limit, the next resource you try to create is refused, and you are never charged for exceeding one.

We may change prices with at least 30 days’ notice by email. A price change takes effect at your next renewal, and you may cancel before it applies.

5. Cancellation and what happens to your data

You may cancel at any time from the billing page. Cancellation takes effect at the end of the period you have already paid for — we do not cut service off on the day you click.

After a paid plan ends, your organisation returns to the free plan. In practice:

  • Monitors above the free limit are paused, not deleted.
  • Remaining checks run at the free plan’s interval.
  • History is retained for the free plan’s retention period.
  • Status pages above the free limit stop being served but are not deleted.

If you delete your organisation, we delete its data within 30 days, except where we are required to keep records of transactions for tax and accounting purposes.

6. Availability

We aim to keep the service running continuously and we monitor it from outside our own infrastructure. We do not offer a contractual uptime guarantee or service credits on the self-serve plans; if you need one, it is available on an Enterprise agreement.

We may perform maintenance that briefly interrupts checks. Where it is planned, we announce it on our own status page.

7. Your data

You keep ownership of everything you put into the service: your monitor configuration, your check history, your incidents and the content of your status pages. We use it to operate the service for you and for nothing else. See our privacy policy.

You grant us the licence necessary to host, process and display that content in order to provide the service — including publishing what you choose to publish on a status page.

8. Liability

The service is provided as is. To the fullest extent the law allows, we are not liable for indirect or consequential loss, loss of profit, loss of business, or losses arising from an outage we failed to detect or notify you about.

Our total liability in any twelve-month period is limited to the amount you paid us in that period. Nothing in these terms limits liability for fraud, death or personal injury caused by negligence, or anything else that cannot lawfully be limited.

Stated plainly, because it matters more here than in most software: a monitoring tool can fail to notice something, and it can fail to reach you. Do not build a process that depends on this service being the only thing that would tell you.

9. Suspension and termination

We may suspend or terminate an account that breaches these terms or the acceptable use policy, that is being used to attack a third party, or where payment has failed and remains unresolved after our provider has stopped retrying. Where circumstances allow, we will tell you first and give you a chance to put it right.

10. Changes

We may update these terms. For material changes we will email account owners at least 30 days before they take effect. Continuing to use the service after that constitutes acceptance.

11. Governing law and contact

These terms are governed by the laws of Georgia, and the courts of Tbilisi have jurisdiction. This does not remove any protection you have under the mandatory law of your own country of residence.
